Terms of service

§ 1. General Provisions
- These Terms of Service set out the rules for using the website available at personalgymbox.pl, which enables:
- the purchase of products in the online store,
- booking training services and gym access.
- The owner of the website is Personal Gym Box sp. z o.o., with its registered office at ul. Wadowicka 7, 30-347 Kraków, Poland. NIP (Tax ID): 6793316898, KRS: 0001143847, REGON: 540399780.

- Definitions:
- Store – the online store operated by the Seller.
- Service – the part of the website that allows booking the gym facilities and performing other activities related to training and gym use.
- Order Form – an interactive form available in the Store or Service that allows placing an Order, including determining the terms of the Sales Agreement, delivery, and payment methods.
- Administrator / Owner / Seller / Service Provider – Personal Gym Box sp. z o.o., as defined above, operating the gym facilities, Store, and Service.
- Client – a person using the Store, the Service, or the gym facilities.
- Consumer – a Client who is a natural person performing activities not directly related to their business or professional activity.
§ 2. User Account
- To use the full functionality of the Store, the Service, and the gym facilities, creating a user account may be required.
- The User is obliged to provide truthful data.
- The User is responsible for not disclosing login data to third parties.
§ 3. Sale of Products and Services
- Product information presented in the Store does not constitute an offer within the meaning of the Civil Code but rather an invitation to conclude a contract.
- The Sales Agreement is concluded when the Client confirms the order and the Seller accepts it. After placing an Order, the Seller immediately confirms its receipt and simultaneously accepts it for execution. Confirmation of receipt and acceptance takes place via an email sent to the Client’s address provided during the Order, containing the Seller’s declaration of receipt and acceptance of the Order, along with confirmation of the conclusion of the Sales Agreement. At this moment, the Sales Agreement is considered concluded.
- If the Client chooses:
- electronic payment - the Client must pay at the time of concluding the Sales Agreement.
- cash on delivery - the Client must pay upon receipt of the shipment.
- Prices in the Store are gross prices (including VAT).
- Available payment methods: electronic payment, bank transfer (if available), cash on delivery (if available).

- Delivery is available to the countries selectable in the Order Form. The Product will be delivered within no later than 14 business days, in the manner chosen by the Client.
- Delivery time starts:
- for electronic payments - from the date the Seller’s bank account is credited,
- for cash on delivery - from the date of the Sales Agreement.
- By placing an order in the Store or Service, the Client requests an invoice instead of a receipt and consents to receive it electronically at the email address provided in the Order Form or, in the case of PGB Tokens, the email address linked to the user account.
- PGB Tokens - multi-purpose vouchers that can be used to purchase any product in the Store and to book gym facilities or other services available in the Store or Service. Tokens are assigned to a user account and work as an account balance. PGB Tokens do not expire and are generally non-refundable and non-exchangeable for cash, except in cases specified in these Terms, such as cancellation of a booking within the period set out in § 6, when Tokens may be returned to the user account. PGB Tokens may also be granted free of charge (e.g., promotions, rewards, surveys).
§ 4. Right of Withdrawal (Products)
- A Consumer has the right to withdraw from the agreement within 14 days of receiving the product without giving any reason.
- It is sufficient to send a declaration before the deadline.
- The returned product must be in an intact condition (unless opening it was necessary for normal inspection).
- The right of withdrawal does not apply in cases provided by law (e.g., opened hygienic products, multi-purpose vouchers such as PGB Tokens).

§ 5. Complaints (Products)
- The Seller is liable to the Consumer for product conformity with the agreement.
- Complaints should be submitted in writing or via email.
- The Seller will respond within 14 days.
§ 6. Booking Access to Personal Gym Box Facilities
- Bookings can be made through the online system available in the Service.
- Payments for bookings are made using PGB Tokens (multi-purpose vouchers purchased earlier).
- Cancellations are allowed no later than 2 hours before the booked time. Otherwise, Tokens used for the booking are non-refundable. The Client is entitled to 3 free cancellations per month. Additional cancellations may result in a Token deduction as displayed before cancellation.
§ 7. Complaints (Services)
- Complaints regarding services must be submitted in writing or by email.
- The Service Provider will review the complaint within 14 days.
§ 8. Liability and Gym Rules
- Clients under the age of 18 may use the gym only with the consent and under the responsibility of their parents or legal guardians. A Client under the age of 18 declares that their parents/legal guardians have given consent to use the gym and accept full responsibility for the Client's actions and any damages caused while using the facility. The Administrator shall not be held liable for any consequences resulting from concealing the lack of such consent.
- The Client must use the gym facilities exclusively for recreational and sports purposes.
- The Client must use the equipment in accordance with its intended use, instructions, and safety rules.
- The Client must wear sports clothing and footwear.
- It is prohibited to dismantle equipment.
- It is prohibited to leave personal items in the training area outside designated places (lockers, changing rooms).
- It is prohibited to bring or consume alcohol, drugs, or intoxicants.
- It is prohibited to smoke cigarettes or e-cigarettes inside the gym.
- It is prohibited to use equipment while intoxicated or under the influence of drugs.
- It is prohibited to sleep, stay overnight, or remain on the premises outside booked hours.
- The Administrator is not responsible for valuables left unattended.
- The Client bears all costs arising from improper use of the facility by themselves or by persons they allowed to enter, including triggering alarms (staying beyond reserved time) or fire alarms (e.g., smoking, open flames, or other violations).
- The Client uses the gym at their own risk and is fully responsible for their health and the health of persons they allowed entry. The Client confirms that there are no medical contraindications to exercise for themselves or others they allowed entry.
- It is recommended to train with a spotter when performing strength exercises.
- The Client is responsible for their own behavior and for the safety and behavior of persons they allowed entry, including liability for any damage they cause - even if the Client is not present.
- The Administrator is not liable for damage, destruction, or loss of the Client’s or their guests’ belongings (e.g., clothing, phones, electronics, documents, keys, money), unless the damage was caused solely by the Administrator’s fault.
- The Client undertakes to cover all losses and damages caused to gym property or third parties by themselves or persons they allowed entry.
- Equipment and furnishings may only be used inside the gym and as intended.
- It is strictly forbidden to remove equipment or furnishings from the gym without explicit consent from the Administrator.
- The Client is materially responsible for damage, destruction, or loss of equipment and gym furnishings, including those caused by persons they allowed entry.
- At most 10 people may be present in the gym at the same time.
- After training, equipment must be returned to its designated place.
§ 9. Personal Data and CCTV Monitoring
- The Administrator defined above is the controller of personal data.
- Personal data is processed for the purpose of order fulfillment, service bookings, and ensuring safety on the gym premises.
- The gym is under video surveillance as described in the Privacy Policy.
- Details on data processing are set out in the Privacy Policy.
§ 10. Final Provisions
- These Terms are available free of charge on the website.
- The Seller reserves the right to amend these Terms – the new version applies from its publication date. The Seller undertakes to inform Clients about changes.
- Polish law governs these Terms.
- Consumers also retain rights and claims against the Seller under the laws of their country of residence.
- For matters not regulated herein, the provisions of Polish law apply, in particular the Civil Code and the Consumer Rights Act.
